1. WHAT INFORMATION ABOUT ME IS COLLECTED?
In connection with your use of the Service, we may collect information about you. in general, such information may include your name, username, email address, password, profile photo, bio, favorite cuisines, saved restaurant lists, photos uploaded by you, notes about your dining experience, ratings or community scores, message content, recommended cuisines, social media posts, XP points, level, streaks, badge/achievement data, favorites and saved lists, follow relationships, likes on check-ins, comments on check-ins, device tier/performance data, referral/invite codes, and, subject to Section 10 of the Terms of Service, any information that you choose to share through the Service. Additionally, our Outside Contractor (as defined below) that is responsible for billing and payment processing services (the “Payment Services Provider”) may collect your billing and credit card information from you directly. In addition, we may collect social media handles, linked accounts, user content, and precise geolocation as described below.
We may also collect other information that in some cases may be identifiable, such as demographic information, browser types, unique device identifiers, device types, requested URL, referring URL, browser language, the pages you view, the date and time of your visit, domain names, and statistical data involving the use of the Service. To the extent any such information can be used to identify you or can be tied to you in an identifiable manner, such information amounts to ‘personal data’ for the purposes of and as defined in the European Data Protection Laws (to the extent applicable).
1.1 Social Media Handles, Linked Accounts, and User Content.
If you choose to provide a social media handle, connect a third-party social media account, or submit, post, or otherwise share content through the Service, we may collect and process that information, including associated profile information and content made available to us through your settings with the third-party service. Depending on your account settings and the nature of the feature, certain profile information, check-ins, reviews, lists, likes, comments, and other content you share through the Service may be visible to other users.
1.2 Precise Geolocation Information.
We collect precise geolocation information only if you affirmatively permit the Service to access your device location through your device’s permission settings. Precise geolocation is optional and is used only to provide, personalize, and improve the Service’s location-based features, such as surfacing nearby restaurants and relevant content. You may disable location access at any time in your device settings.
2. WHERE AND WHEN IS INFORMATION COLLECTED (INCLUDING THROUGH THE USE OF COOKIES AND ACTION TAGS)?
2.1 General Sources
We may obtain your information in the following ways:
- We will collect information that you submit to us;
- From users of the Service (subject to Section 10 of the InstaTaste Terms of Service);
- Publicly available information, where permitted by applicable law, including information from public social media profiles, posts, blogs, articles, reviews, and publicly accessible websites.
- From third parties providing credit and debit card authorization and fraud screening services as part of your use of the Service; and
- If you identify yourself to us by communicating with us, including by sending us an email with questions or comments.
2.2 Registering to Use the Service and in the Course of Using the Service.
You may be required to establish an account in order to take advantage of certain features of the Service. If so, if you wish to establish an account you may be required to provide us with certain of the information described in Section 1.
If you choose to sign in through or connect a third-party account, such as Apple, Google, Instagram, TikTok, or another social media service, we may receive the username, name, email address, unique account identifier, profile photo, and other information made available to us by that service based on the provider’s policies and your account settings and authorization. Without limitation of Section 5, we use this information as set out in this Privacy Policy, including to authenticate your account, create or maintain your account profile, and provide the Service.
2.3 Cookies and Similar Technologies
We and our service providers may use cookies and similar technologies, such as software development kits (SDKs), pixels, local storage, web beacons, and similar tracking technologies, to collect information about how users access and use the Service. These technologies may be used on our Site and, where applicable, in our mobile application.
We use these technologies for purposes such as: (i) operating, securing, maintaining, and improving the Service; (ii) remembering user preferences and settings; (iii) understanding how users interact with the Service; (iv) measuring the performance of content, features, and communications; and (v) where permitted and applicable, supporting marketing, promotional, advertising, or related measurement activities.

We retain information collected through cookies and similar technologies for as long as reasonably necessary for the purposes described in this Privacy Policy, including to operate the Service, maintain security, comply with legal obligations, and enforce our agreements. The duration of a cookie or similar technology may vary depending on whether it is session-based or persistent and on the relevant provider’s practices.
2.4 Log Files.
We also collect information through our Internet log files, which record data such as user IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Service. This information may be used to analyze trends, to administer the Service, to monitor the use of the Service, and to gather general demographic information. We may link this information to other information about you for these and other purposes such as personalizing your experience on the Service and evaluating the Service in general.
2.5 Public Areas.
The Service may feature various community areas and other public forums (the “Public Areas”) where Service users can share information and post questions for others to answer. These Public Areas are open to the public and should not be considered private. We cannot prevent information included within a Public Area from being used in a manner inconsistent with this Privacy Policy, the law, or your personal privacy. We are not responsible for the results of such postings or for the accuracy of any information contained in those postings.
Any information you share in a Public Area is by design open to the public and is not private. You should think carefully before posting any information in any Public Area. What you post can be seen, disclosed to or collected by others and may be used by others in ways we cannot regulate or predict. As with any public forum on any website, the information you post may also show up in third-party search engines like Google or Bing. If you mistakenly post information in a Public Area, you can send us an email to request that we remove it by contacting us using the details set out in Section 13. You should understand that in some cases, we may not be able to remove your information.
3. IS INFORMATION SUBMITTED TO THE PUBLIC AREAS OF THE SERVICE PRIVATE?
No. Any information shared in the Public Areas of the Service is available to the public, including to all users. Such information is not treated as confidential. If you wish to keep any information private or proprietary, do not submit it to the Public Areas of the Service. NOTWITHSTANDING THE FOREGOING, WE HAVE NO RESPONSIBILITY OR LIABILITY IF A USER’S INFORMATION OR IDENTITY IS MISUSED OR STOLEN, OR IF A USER SUFFERS HARM AS A RESULT OF VOLUNTARY DISCLOSURES.
In addition, please be aware that your username may be available to the public, including to all users, when you share or post information in the Public Areas of the Service. When prompted to create a username, we advise users to use non-personally identifiable information – i.e., select a username that is not similar to a user’s actual name – because such information can be publicly available to all users.
4. DOES INSTATASTE COLLECT INFORMATION FROM CHILDREN UNDER 13 YEARS OF AGE?
We are committed to protecting the privacy of children. The Service is not designed for or directed to children under the age of 13. We do not collect information from any person we actually know is under the age of 13.
5. WHAT DOES INSTATASTE DO WITH THE INFORMATION IT COLLECTS?
Pursuant to the European Data Protection Laws, legal bases for our processing your information may include (without limitation):
(a) where you have given consent to the processing, which consent may be withdrawn at any time without affecting the lawfulness of processing based on consent prior to withdrawal;

We may also use the information collected to send announcements and updates regarding the Service or, if applicable, about your billing account status. You will not be able to unsubscribe from these Service announcements and updates as they contain important information relevant to your use of the Service and are necessary for the performance of our contract with you.
We may also use the information gathered to perform statistical analysis of user behavior or to evaluate and improve the Service. We may link some of this information to other information for internal purposes or to improve your experience with the Service. In addition, we may deidentify or anonymize your information. Where information has been anonymized so that you are not, or are no longer, identifiable by means reasonably likely to be used, we may use and/or disclose that deidentified or anonymized information for our lawful business purposes. Location access is optional and is not required to use the Service’s core functionality. If you choose not to allow location access, you can still use the Service by manually searching for a city, state, or other location, although certain location-based features may be less precise or convenient.
We may also use algorithms to process the information we collect in order to personalize content, recommendations, search results, and other aspects of the Service based on factors such as your activity, preferences, saved items, and location information. In some jurisdictions, this type of processing may constitute profiling under applicable law, including the European Data Protection Laws. 6. WHEN DOES INSTATASTE DISCLOSE INFORMATION TO THIRD PARTIES?

With respect to the third parties to whom InstaTaste discloses your information, InstaTaste takes commercially reasonable steps, including contractual measures where appropriate, designed to require that such third parties provide protections for your information that are consistent with this Privacy Policy and applicable law.

We may provide information to third parties, including where such information is combined with similar information of other users of the Service. For example, we might inform third parties regarding the number of unique users who use the Service, the demographic breakdown of our users of the Service, or the products and/or services purchased using the Service and the vendors of such products and services. We may employ independent contractors, vendors, suppliers, and other service providers (collectively, “Outside Contractors”) to provide specific services and products related to the Service, such as hosting and maintaining the Service, cloud storage, database infrastructure, authentication, push notifications, mapping, geocoding and location-related services, content delivery, and developing applications or other technical services for the Service. We may also engage service providers, including the Payment Services Provider, in connection with additional features or functionality that we may offer from time to time, such as payment processing, fraud prevention, customer support, communications delivery, or analytics. In the course of providing products or services to us, these Outside Contractors may have access to information collected through the Service, including your information. We use reasonable efforts to ensure that these Outside Contractors are capable of protecting the security of your information and handling it in a manner consistent with this Privacy Policy.

We reserve the right to transfer information to a third party in connection with a sale, merger, acquisition, financing, due diligence, reorganization, bankruptcy, receivership, dissolution, asset sale, or other transaction involving all or part of InstaTaste’s business, assets, or equity, including any transaction involving any Corporate Affiliate (as defined below) or the portion of any business to which the Service relates. 8. IS THE INFORMATION COLLECTED THROUGH THE SERVICE SECURE?
We want your information to remain secure. We strive to provide transmission of your information from your computer or mobile device to our servers using secure transmission protocols and through techniques that are consistent with commercially reasonable standards, and to employ administrative, physical, and electronic measures designed to protect your information from unauthorized access, loss, misuse, disclosure, alteration, and destruction.
Notwithstanding the above, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. Do Not Track.
The term “Do Not Track” refers to a HTTP header offered by certain web browsers to request that websites refrain from tracking the user.
